Washington County Grand Jury indicts 27, including four in shooting

MARIETTA — The Washington County Grand Jury indicted 27 people Wednesday morning including four people for their involvement in a September shooting on Greene Street in Marietta that resulted in a woman getting shot in the face.

The grand jury also indicted Beverly Police Chief Todd Bumbalough for a domestic violence incident involving a juvenile female family member.

Kylar James Wilson, 20, 731 Greene St., Marietta, was indicted on one first-degree felony count of attempt to commit an offense, with a firearm specification for three years; one third-degree felony count of tampering with evidence; and three second-degree felony counts of felonious assault, each with a firearm specification of three years.

The indictment stated Wilson knowingly caused or attempted to cause physical harm to the victim of the shooting by means of a firearm and that he engaged in conduct that had it been successful would have resulted in the offense of murder by shooting a firearm and striking the victim’s face.

Washington County Prosecutor Nicole Coil clarified that the charge of attempt to commit an offense is for attempted murder. She said previous charges included in an Oct. 8 indictment for Wilson will be dismissed and the charges from the indictment Wednesday will supersede the original charges.

Madison Marie Brant, 23, 707 Sixth St., Marietta, was indicted as a co-defendant with Wilson, on one third-degree felony count of tampering with evidence and a fourth-degree felony count of inducing panic with a firearm specification of one year.

The indictment stated Brant had a firearm on or about her person while committing the offense of inducing panic.

Coil said previous charges included in an Oct. 8 indictment, which included three second-degree felony counts of felonious assault, will be dismissed and the charges from the Wednesday indictment will supersede the original charges.

The charges against Wilson and Brant stem from their alleged involvement in a shooting that took place around 12:55 a.m. Sept. 28 in the Advance Auto Parts parking lot at 200 Greene St. Marietta Police previously told The Times officers were responding to a call at Fourth and Putnam streets when they heard gunshots downtown and responded to the scene to find a woman had been shot in the face but was still conscious. Police discovered 38 shell casings at the scene and determined four people with four handguns were involved in the shooting.

The other two suspects involved in the shooting, Ashton J. Dugan, 20, 1046 Laird Ave., Parkersburg, and Brendon M. Pierce, 18, 3109 Elm St., Parkersburg, were also indicted Wednesday as co-defendants, on one third-degree felony count of tampering with evidence; one fourth-degree felony count of aggravated assault, each with a firearm specification for three years; and one second-degree misdemeanor count of obstructing official business.

The indictment states Dugan and Pierce each had a firearm on their person and knowingly attempted to cause physical harm to Wilson by means of a firearm.

Wilson has not yet been arraigned on the charges in the new indictment and Washington County Jail records show he was arrested Oct. 8 on the old charges and has not been released. No bond has yet been set for the new charges.

Brant has not yet been arraigned on the charges in the new indictment nor has bond been set for them. Jail records show she was arrested Oct. 17 for the old charges and released Oct. 22.

Dugan was arraigned Wednesday and entered a not guilty plea. A personal recognizance bond was ordered for all charges with one of the conditions being no contact with Wilson, Pierce or the victim without counsel present. Jail records show he was arrested and released Wednesday.

According to court records, Dugan’s trial is set for 9 a.m. Feb. 11 with Washington County Court of Common Pleas Judge John Halliday’s presiding.

Pierce has not yet been arraigned and he has not entered a plea on the charge, according to court records.

According to jail records Pierce was put in the jail Oct. 11 and was released Oct. 11 after bond was set at a total of $30,000 for charges at the time of obstructing official business, tampering with evidence and attempted aggravated assault.

According to court records, no bond has been set on the charges included in the indictment, some of which are different from the charges listed at the time Pierce was arrested.

Bumbalough, 56, of Beverly, was also indicted Wednesday on one fifth-degree felony count of obstructing official business and one first-degree misdemeanor count of domestic violence.

The charges stem from an Oct. 6 incident at Bumbalough’s residence involving a 14-year-old female family member during which the child alleges she was in a verbal argument with a woman at the house and Bumbalough became involved in the argument, tackled her onto her bed and in doing so hit her in the face causing her glasses to break and injuring her right eye.

There was also a claim made in Marietta Municipal court documents by the Beverly Police officer that responded to the incident at Bumbalough’s residence that the officer handled the call differently because it involved Bumbalough and he thought the Washington County Sheriff’s Office should have gotten the call but Bumbalough did not tell him to call the Sheriff’s Office.

Bumbalough was booked into the Washington County Jail Oct. 8 for the charges and was released Oct. 9, jail personnel previously told The Times.

There was a hearing Oct. 16 in Marietta Municipal Court during which the felony charge was originally dismissed and no action was taken on the misdemeanor charges and during which it was mentioned the Washington County Prosecutor’s Office had requested a special prosecutor from the Ohio Attorney General’s Office.

According to the indictment Marietta City Law Director Paul Bertram is the special prosecutor for Bumbalough’s case. No hearings or trial have yet been set for Bumbalough in the Washington county Court of Common Pleas.

The others indicted include:

* Moses Schmucker, 50, 705 Young Street South East, Massillon, Ohio, was indicted on one fourth-degree felony count of improperly handling firearms in a motor vehicle with a specification for forfeiture of a weapon from May 2023.

* Justin Bruce Ketterman, 38, 151 Highland Lake Terrace, Washington, W.Va., was indicted one second degree felony count of aggravated trafficking in drugs, one second-degree felony count of aggravated possession of drugs, and one fifth-degree felony count of aggravated possession of drugs from December 2023. In a separate case Ketterman was indicted on one third-degree felony count of aggravated trafficking in drugs, one third-degree felony count of aggravated possession of drug, one fifth-degree felony count of trafficking in a fentanyl-related compound and one fifth-degree felony count of possession of drugs from February.

* William Thomas Klintworth, 60, 321 Sherlock Rd., Waterford, was indicted on one first-degree felony count of aggravated menacing; one third-degree felony count of intimidation and one fifth-degree felony count of obstructing official business, both with a firearm specification for one year; and one third-degree felony county of having weapons under disability, with eight specifications for forfeiture of a weapon while under disability from Oct. 8.

* Willis Patrick O’Brien, 31, 2840 Salt Springs Rd., Grant, Ohio, was indicted on two fourth-degree felony counts of failure to provide notice of change of address from May 2023.

* Robert K. Warren, 51, 212 Simmons Dr., Ripley, was indicted on one fifth-degree felony count of aggravated possession of drugs from June 2021.

* Douglas Jackson II, 25, 2171 Jackson Blvd., Cleveland Heights, Ohio, was indicted on one fifth-degree felony count of possessing criminal tools from May 2021.

* Allen Richard Sampson, 35, 206 Brentwood St., Marietta, was indicted on one third-degree felony count of failure to provide notice of change of address from February.

* Nathaniel George Lee Payne, 23, 127 Muskingum Dr., Marietta, was indicted on one third-degree felony count of failure to provide notice of change in vehicle information or identifiers from March.

* Justin Wayne Fore, 43, 1658 Pansy Dr., Charleston, W.Va., was indicted on one fifth-degree felony count of identity fraud from October 2022.

* William Albert Kennedy, 58, 6505 Valley Dr., East Sparta, Ohio, was indicted on one second-degree felony count of aggravated trafficking in drugs and one second-degree felony count of aggravated possession of drugs from November 2021.

* Ryan Eugene Paxton, 37, Waterford, was indicted on one first-degree felony count of aggravated burglary, one first-degree misdemeanor count of domestic violence, one first-degree misdemeanor count of endangering children, and one first-degree misdemeanor count of using weapons while under intoxicated from July.

* John William Dearing, 45 , 275 Front St., Marietta, was indicted on one fifth-degree felony count of theft from July.

* Justin Joe Moore, 36, 1380 Wheeler Rd., Zanesville, was indicted on one fourth-degree felony count of improperly handling firearms in a motor vehicle, with a specification for forfeiture of a weapon, and one fifth-degree felony count of unlawful possession of dangerous ordnance, with a specification for forfeiture of a weapon, from February.

* Chaden Christopher Bruce, 21, 709 Ninth St., Marietta, was indicted on one fifth-degree felony count of aggravated possession of drugs from June.

* Kylie Rae McCoy Farnsworth, 21, 202 East Fay Ave., Marietta, was indicted on one fifth-degree felony count of aggravated possession of drugs from April.

* Stephan Neale McGuire, 43, 223 Maple St., Belpre, was indicted on one third-degree felony count of tampering with evidence and one third degree felony count of aggravated possession of drugs. His co-defendant, Samantha Joe Stauffer, 38, 523 Second St., Marietta, was indicted on one third-degree felony count of tampering with evidence, one third-degree felony count of aggravated possession of drugs and one fourth-degree felony count of possession of a fentanyl-related compound. Both defendants’ charges were from January.

* David William Strattion, 69, and co-defendant Julia Mare Porter, 58, both of 11776 State Route 555, Cutler, were each indicted on one second-degree felony count of aggravated trafficking in drugs and one second-degree felony count of aggravated possession of drugs, each with 28 specifications for forfeiture of a gun in a drug case; one third-degree felony count of having weapons while under disability; and one fourth-degree felony count of receiving stolen property from August. Co-defendant Joan Irizarry, 61, 2705 Lake Rd., Fleming, was indicted on one fifth-degree felony count of aggravated possession of drugs from August.

* Lisa Lee Patterson, 29, 309 Maple St., Unit D, Marietta, was indicted on one fifth-degree felony count of theft from June to September.
