Fly gets 40 years in prison
By JEFFREY SAULTONPARKERSBURG - A sentence of 40 years in prison was handed down Tuesday for a Wood County man who pleaded guilty to a charge of second-degree murder.
Fredrick Wayne Fly II, 32, in custody at the North Central Regional Jail, pleaded guilty to the April 2007 murder of John Monroe, 52. Fly pleaded guilty to the charge on Oct. 1, 2008. At first Fly rejected a plea and then changed his mind again and accepted the plea.
In pronouncing the sentence Tuesday, Wood County Circuit Judge Robert Waters stated "alcohol has permeated this case as both parties were intoxicated." Waters said Monroe was beaten by Fly and read a list of injuries listed in the autopsy report. Among those were head injuries, pattern abrasions on the head, several injuries to the arms, fractured ribs and evidence he bled to death.
"This was not a matter of punch thrown and someone falling down and sustaining an injury," he said. "It was a beating."
Waters said Fly's sentence would have credit for 292 days served prior to his February sentencing on a wanton endangerment bill of information. That stemmed from a December 2006 incident where he detained his mother, Rosa Fly, at their home at 140 Sunset Blvd., Parkersburg, against her will. Waters said in the incident Fly pointed a loaded and chambered gun at a sheriff's deputy when the home was entered by law enforcement.
Prosecutor Ginny Conley said the state opposed giving Fly credit for time served.
"We ask the court to put him away for as long as it can," she said. "John Monroe died from multiple blunt force trauma. He bled to death; he laid there and he suffered. We ask that Fly be given no credit for time served."
Fly addressed the court during the hearing.
"I'm sorry for what I did and I'm sorry alcohol was a catalyst in taking the life of one and ruining the life of another," he said.
Fly then turned and addressed two of Monroe's family members.
"I know what it's like to lose someone and I apologize. I know words cannot justify what I did," he said.
In addition to the 40-year sentence, Waters awarded restitution to Monroe's mother for the funeral, transport to the hospital, grave marker and care home expenses for her, totaling $49,318.17. Waters said her powers of attorney may apply to the state crime victim's fund for restitution.
In another hearing, George J. Sadie Jr., 43, 1803 Washington Ave., Parkersburg, was granted a motion from his attorney to continue his trial to the January court term. Circuit Judge J.D. Beane set the new date for March 24, 2009, case No. 1. Sadie was indicted by the September 2007 grand jury on a charge of possession of a controlled substance with intent to deliver.
